Terms of Use
Effective date: March 15, 2025
These Terms of Use set forth the rights and obligations between ESPORTS CAFE 5G (the āStoreā) and its members regarding the services provided by the Store. Members shall use the services only after agreeing to these Terms.
Chapter 1: General
Article 1 (Scope)
- These Terms apply to all relationships between members and the Store in connection with the use of the services.
- The Store may separately establish rules, guidelines, important notices, and other provisions (collectively, āIndividual Provisionsā). Regardless of their name, Individual Provisions constitute part of these Terms.
- If these Terms conflict with any Individual Provisions, the Individual Provisions shall prevail.
Chapter 2: Membership
Article 2 (Registration)
- Registration is completed when an applicant agrees to these Terms, applies using the Storeās prescribed method, and the Store approves the application.
- The Store may refuse registration if any of the following applies:
⢠False information in the application
⢠The applicant has previously been expelled or suspended
⢠The applicant is affiliated with organized crime or other anti-social forces
⢠The Store otherwise deems the application inappropriate - The Store has no obligation to disclose the reasons for refusal.
Article 3 (Identity Verification)
- At registration and as necessary, the Store may request presentation of identification documents that confirm name, address, and date of birth (e.g., driverās license, passport, health insurance card, student ID).
- If a member does not comply, the Store may suspend use or terminate membership.
Article 4 (User ID and Password)
- Members shall manage their user ID and password at their own responsibility.
- Members must not lend, transfer, or share their credentials with any third party.
- Any login using a user ID and password will be deemed to be the memberās own use.
- The Store shall not be liable for damages caused by credential leakage unless the Store is at fault through willful misconduct or gross negligence.
Chapter 3: Points and Fees
Article 5 (Store Points; Refunds)
- Any amount charged by a member will be managed as āStore Pointsā that can be used to pay for Store services.
- Store Points may be used only for Store services and cannot be exchanged for cash, transferred, or refunded.
- As a general rule, the Store will not refund Store Points at the memberās request.
- However, if the provision of services becomes substantially difficult due to reasons attributable to the Store, the Store may, at its discretion, refund the unused portion of Store Points or provide an alternative remedy.
Article 6 (Expiration)
Store Points expire 24 months after the last date of use and will be forfeited thereafter. No refund or compensation will be provided for expired points.
Article 7 (Service Fees)
The fee structure and calculation method are determined separately by the Store and will be announced via in-store posting or on the website.
Chapter 4: Member Obligations
Article 8 (Prohibited Acts)
Members must not engage in any of the following:
- Acts that violate laws or public order and morals
- Criminal acts or acts related to criminal acts
- Smoking outside designated areas; smoking/drinking by minors; entering while heavily intoxicated; shoplifting; theft; or other illegal acts
- Use by customers under 18 between 11:00 p.m. and 4:00 a.m. pursuant to the Tokyo Ordinance for the Healthy Development of Youth
- Taking store fixtures, equipment, or supplies other than purchased items
- Using another memberās account (intentional or negligent), lending/sharing accounts, or multiple simultaneous logins
- Installing software without permission, changing settings on in-store PCs, or bringing unauthorized wireless devices
- Accessing adult sites or adult content
- Mass data transfer via P2P; nuisance behavior; unauthorized communications; spam; privacy infringement
- Staying in the Store without logging in to an in-store PC; unlawful stay
- Indecent behavior inside the Store
- Advertising, solicitation, picking up strangers, gambling, or violence inside the Store
- Bringing hazardous materials
- Unauthorized photography, recording, or live streaming inside the Store
- Use by persons in an unclean condition or emitting strong odors
- Interfering with the Storeās, other usersā, or third partiesā servers or network functions
- Interfering with the operation of the Storeās services
- Unauthorized access or attempts thereof
- Use for improper purposes
- Acts causing disadvantage, damage, or discomfort to other members or third parties
- Providing benefits to anti-social forces
- Other acts deemed inappropriate by the Store
Chapter 5: Operations and Management
Article 9 (Lending Equipment)
- The Store may lend controllers, cables, and other equipment (āLoan Itemsā).
- To use Loan Items, the Store will hold the original of a government-issued ID designated by the Store. If you cannot present the ID, lending may be refused.
- The ID will be returned after the Store confirms the condition and quantity of the returned Loan Items.
- If loss, damage, or unreturned Loan Items are confirmed, the member shall compensate the full cost (actual expenses) required to procure replacements.
Article 10 (Network and Account Management)
- Members are responsible for managing online game accounts, social media, and other accounts used on in-store PCs.
- Please log out after use. The Store is not responsible for any damages caused by failure to log out.
- Changing settings or installing software on in-store PCs without permission is prohibited.
Article 11 (Photography / Recording / Live Streaming)
- Photography, recording, and live streaming inside the Store require prior permission.
- If you capture other customers, you must obtain their consent.
- If unauthorized filming is found, the Store may suspend use, request you to leave, and revoke membership.
Article 12 (Security Cameras)
The Store has security cameras for crime prevention. Recorded data will not be used for purposes other than security.
Article 13 (Lost Items)
Lost items will be kept for a certain period and may then be disposed of at the Storeās discretion.
Article 14 (Damage to Facilities)
If facilities are damaged due to a memberās intentional act or negligence, the Store will charge actual expenses.
Chapter 6: Withdrawal / Suspension
Article 15 (Suspension / Termination)
- If a member violates these Terms, has unpaid fees, or is deemed inappropriate by the Store, the Store may suspend use or terminate membership without prior notice.
- The Store is not liable for any damages arising from such measures.
Article 16 (Withdrawal)
Members may withdraw by completing the prescribed procedure. No refund of remaining points will be made upon withdrawal.
Chapter 7: Disclaimers
Article 17 (Disclaimer)
- The Store does not guarantee the completeness of equipment, communications, or game operation.
- The Store is not responsible for disputes between members, loss/theft of belongings, gambling, or account leakage.
- The Store is not liable except in cases of willful misconduct or gross negligence.
- Even if the Store is at fault (excluding gross negligence), compensation is limited to the usage fees paid by the member in that month.
- For security and operational reasons, the Store generally cannot comply with requests to individually manage entry/exit, monitor behavior, or report a memberās presence to third parties (including guardians).
Chapter 8: Changes / Governing Law
Article 18 (Changes to Terms)
The Store may change these Terms. The revised Terms will take effect upon in-store posting or website notice.
Article 19 (No Assignment)
Members must not assign or provide as security any contractual position or rights/obligations without the Storeās prior consent.
Article 20 (Governing Law / Jurisdiction)
These Terms are governed by Japanese law. Any dispute shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Storeās location.
Chapter 9: Member Pledges
- If equipment is damaged due to a memberās negligence, the Store will charge actual expenses.
- If you disturb other customers, you may be asked to leave.
- If suspicious circumstances arise, the Store may request a bag check.
- Pets are not allowed.
- Outside food and drinks are allowed, but please refrain from bringing alcohol.
- Manage valuables at your own responsibility (the Store is not responsible for loss or theft).
- Entry may be refused if you are heavily intoxicated.
Supplementary Provisions
- Important matters will be announced via in-store posting or online notice.
- These Terms take effect on March 15, 2025.
